Transfer of a Property in Curaçao
Buying a home in Curaçao is an exciting milestone, but the final step: the property transfer, is often the least understood. Whether you’re a first-time buyer or an international investor, knowing what happens during the transfer helps you avoid surprises and ensures a smooth, stress-free experience.
This guide breaks down the entire property transfer process in Curaçao, including the notary procedure, inspections, apartment transfers, and new-build purchases.
What Is a Property Transfer in Curaçao?
The property transfer is the moment you legally become the owner of the home. At this appointment, the property officially changes hands, and you take on all responsibilities associated with ownership, such as the mortgage, taxes, maintenance, and insurance.
For most buyers, this is the final and most important step in the purchasing process.
When Does the Transfer Take Place?
On average, the transfer of a home in Curaçao happens:
3–6 weeks after mortgage approval, or
3–6 weeks after signing the preliminary purchase agreement if the purchase is made with your own funds.
These timelines may vary depending on bank processing speed, document preparation, and notary scheduling.
Transfer of an Existing Property in Curaçao
When buying an existing home, the transfer process consists of two stages:
- Final inspection of the property
- Signing the transfer deed at the notary
1. Final Inspection Before the Transfer
Before heading to the notary, you meet the seller at the property to confirm it has been delivered according to the agreement.
During this inspection, you should verify:
- All agreed-upon items (curtains, appliances, furniture) are present
- The home is delivered clean and empty
- No belongings from the seller remain
- Any repairs or defects mentioned in the agreement have been resolved
- Utilities are functioning as expected
This is your last moment to ensure the home matches what was promised.
2. Signing the Transfer Deed at the Notary
If the inspection is satisfactory, you proceed to the notary for the legal transfer, also known as passing the deed.
Present at the notary are:
The buyer
The seller (or their authorized representative)
The notary
Sometimes a staff member representing the mortgage lender
The notary reads the deed of transfer (transportakte) and explains the contents. Once both parties sign, the property legally becomes yours.
Signing the Mortgage Deed
If you are financing the home with a mortgage, you also sign the mortgage deed.
After signing, the notary immediately pays the purchase amount to the seller.
This marks the official completion of the transaction, and you receive the keys to your new home.
Transfer of an Apartment in Curaçao
Buying an apartment includes one extra element: the Homeowners’ Association (VvE).
After signing at the notary:
The seller is no longer a member of the VvE
You automatically become the new member
If the previous owner had outstanding VvE fees, you are not responsible for these debts.
The notary documents this, ensuring you begin with a clean slate.
Transfer of a New-Build Home in Curaçao
Purchasing a new-build home usually involves two separate transfers:
1. Transfer of the Land (via the notary)
This follows the same process as buying an existing home.
2. Construction Payments in Installments
The builder receives payments based on construction milestones.
If you have a mortgage, the bank often appoints an inspector to verify progress before releasing funds.
This protects you financially and ensures proper construction oversight.
Insurance Requirements Before Transfer
Before signing the mortgage deed, lenders in Curaçao require specific insurance policies because the home serves as loan collateral.
You must have these in place prior to transfer. Local providers make this process simple and fast.
Costs Associated With a Property Transfer
A property transfer also comes with costs, including:
- Notary fees
- Transfer tax
- Mortgage deed fees (if applicable)
- Administrative costs
