Unfortunately, I have to disappoint you. When you buy property in Curaçao, the rates for the most common notarial services are set by the Common Court of Justice. All rates are subject to:

  • 8.5% office and handling charges

  • 6% sales tax (OB) on all notarized rates

  • Stamp duty of NAF 10 per A4 page for each deed and each attachment (not subject to sales tax)

These are fixed rates — deviation upward or downward is not permitted.

These rates apply to:

  • Mortgage deeds

  • Real estate transfers

  • Auctions

Minimum rates have also been determined for:

  • Inheritances

  • Division of assets after divorce

  • Formation of limited liability companies and foundations

  • Prenuptial agreements

  • Wills


Purchase & Transfer of Real Estate and Establishment of Mortgages

When buying property in Curaçao, the following costs apply:

  • 4% transfer tax on the purchase price (in principle)

  • Registration of:

    • Mortgage deeds

    • Deeds of transfer

  • Land registry fees for:

    • Registration

    • Official inspections performed by the notary

The notary is required to inspect the Land Registry to verify ownership and legal status, for which additional costs are charged.


Prices

In many cases, you can calculate the notarial fee in advance via the website of your civil-law notary.

When purchasing a plot of land or a house, you will usually still need to pay:

  • The remaining land tax

  • Possible ground lease for the current year


Mortgage Deed Rates

For mortgages, additional costs apply:

  • Debt bond stamp tax:

    • 4% on the principal amount

  • Mandatory insurance (usually arranged through the notary):

    • Risk insurance or life insurance

    • Fire insurance with extensive coverage

  • Some banks also charge a closing fee

These insurance costs are often collected by the financing institution via the notary.


Wills on Curaçao

The minimum rate for a will is:

  • Notarial fee: NAƒ 420.00

  • Stamps: NAƒ 15.00

  • Sales tax: NAƒ 25.20

Minimum total cost for a will:

Prenuptial Agreements on Curaçao

Prenuptial Agreements Before Marriage

  • Marriage conditions: NAƒ 750.00

  • Stamps & registration fee: NAƒ 130.00

  • Sales tax: NAƒ 45.00

Total minimum cost:
👉 NAƒ 925.00

Prenuptial agreements made during marriage usually cost more, as they often include a deed of division of the matrimonial community of property.
